Terms and Conditions
This Agreement is a legal document which sets out your rights and obligations and those of newvista trading as newvistalive.
In this Agreement unless the context otherwise requires, the following expressions shall have the following meanings:
‘Personal Data’ means data which relates to you where you can be identified:
From those data; or
From those data and other information which is in our possession, or likely to come into our possession;
And includes any expression of opinion about you and any indication of our intentions or those of or any other person in respect of you.
‘Processing’ means obtaining, recording or holding information or data or carrying out any operation or set of operations on the information or data, including:
Organisation, adaptation or alteration of the information or data;
Retrieval, consultation or use of the information or data;
Disclosure of the information or data by transmission, dissemination or otherwise making available; or
Alignment, combination, blocking, erasure or destruction of the information or data.
‘Survey’ means any survey made available by us in accordance with the terms of this Agreement for completion by you.
‘Activity’ means any other research related project made available by us in accordance with the terms of this agreement for completion by you.
‘Website’ means the newvista website,
, operated by us or such other website as we may operate in connection with this Agreement.

By registering with us, you accept that you are entering into a contract with us under the terms of this Agreement. Visitors to the Website who do not register with us similarly affirm that they are bound by this Agreement each time they access the Website. You should be aware that this Agreement may change at any time in accordance with clause 18 of this Agreement.
You may not join the newvista panel if you or your immediate family, or people you live with work in marketing or market research of any kind.
Registration to be a panel member is free. You may only register once and may not authorise others to use your registered account; this includes creating multiple-email accounts for the purpose of registering on the panel. Any member found with more than one account will be unsubscribed from the panel and their points forfeited.
By registering with us, you accept that we may contact you by e-mail and by telephone from time to time with details of surveys or activities, including details of points or other rewards you will earn for completing each particular survey. Your points will accumulate as you complete more surveys or participate in other research activities. However, you cannot convert or redeem your points until you have reached 5000 points. We will offer a range of ways to redeem your points; however cash payments can only be made in £50 denominations for the first and each subsequent accrued entitlement.
If you believe you have not received a cheque payment from us which you are due, we will investigate and if it proves to be the correct course of action, replace the cheque free of charge, as long as the query is raised with us within 6 months of the original cheque being issued and the cheque has not reached you through no fault of your own, ie your contact details were correct, but the cheque did not arrive. Any claims for missing cheque payments older than 6 months from the date of issue of the original cheque can only be investigated for a charge of £5.00 which would be deducted from the value of the cheque payment. Similarly, if you locate a cheque you have received from us, but failed to cash it and for any reason require a new cheque to be issued by us, we will again apply a charge of £5.00 for administration. Please note we will require you to send us back the out of date cheque before we can re-issue a new cheque.
You undertake to register using accurate and current information about yourself, including your correct name, address and any other requested details. You also undertake that all information provided by you (whether in response to any survey or otherwise) is, to the best of your knowledge, accurate and complete.
You are eligible to register if you are a UK resident aged 16 or over and are not employed or otherwise affiliated with newvista. If you are not a UK resident or are under 16 years of age and have registered onto the newvista panel you will be unsubscribed and will forfeit any credits that may have been made to your account.
We will not transfer any of your Personal Data for any purpose other than research, or without your explicit permission. However, you consent to the transfer of information provided by you in response to a Survey or other research activity to third parties in generic form i.e. the third party not being able to identify you from the information provided. For example: “8 out of 10 people in the UK are happy with their current job”. You consent to us holding and processing your Personal Data internally for the purposes of assimilating information into appropriate form/s.
If you have selected to receive surveys from our partner Toluna, you will have given consent to have your email address transferred to Toluna for the purposes of inviting you to online surveys via newvista. Your email address will be maintained by Toluna on secure servers hosted in the US. Your email address will only be used to invite you to take part in online surveys and will not be passed onto any other party without your explicit permission.
We reserve the right to unsubscribe any member whose account is inactive for 12 months; this includes removal from the newvista panel and the forfeit of all account points.
For the avoidance of doubt, points can only be earned upon the full completion of a given survey or other research activity. Failure to complete would include but not be limited to, failing the screening questions (e.g. when the survey or research activity is targeted at certain interest groups to which you do not qualify), failing consistency check questions (i.e. quality control), failure to complete all questions, or completing all questions after we have met our response quota.
You agree to abide by our community content guidelines. Our community content guidelines are as follows:
Text based conversations can lead to misunderstandings. Please remember this and assume that comments are meant positively. Please also make all reasonable effort to present your views in a way that is sensitive to the feelings and views of others and is clear. In particular:
- Members may not shout at other members by posting in all capital letters or in any other manner;
- Try to avoid jargon or phrases that other members won’t understand – or if you must use them, please explain what they mean;
- Be sensitive to humour that may offend; and
- Do not post anything unlawful, offensive, indecent, prejudiced, racist, defamatory, harassing or threatening.
Although we would love you to provide links to useful and interesting sources of information that relate to your discussions, please do not create links to external websites for the purposes of promotion, and do not post anything that could be interpreted as self-publicity or promotion. This includes spamming, posting the same or similar message across many discussions, advertising, selling or soliciting. Such activity can mean you will be permanently barred from the community.
Do not post any third-party material that infringes any legal rights, such as copyright or other proprietary rights; this includes images and videos found online.
Do not post the contents of private email or other private messages anywhere in the community.
Our moderation policy asks that members:
Ensure the quality of content on the community by:
- Not falsely representing themselves;
- Accepting responsibility for all material that they publish in the community whether it be text, images or video; and
- Always acknowledging the name of the source of any third-party material legitimately quoted or referred to, and where possible or relevant providing details about the source of the information.
We reserve the right to refuse or revoke registration to newvista with immediate effect, at any time and for any reason. This is without prejudice to any rights you or we may have acquired at the date of revocation.
You may cancel your registration with us at any time by clicking the “unsubscribe” button in the ‘Update my details’ section of the Website or by writing to us at the email address given below in point 22.
You acknowledge that all copyright, trademarks and other intellectual property rights in and relating to newvista (including, without limitation, any relating to information contributed by you in response to any survey) are owned by us. Therefore, no one may copy, distribute, show in public or create any derivative work from the website or any e-mails sent by us, or any material which is found on the Website or in any e-mail sent by us (including without limitation the content of the e-mail itself and the content of any attachment) unless properly licensed to do so by us.
Any third party websites linked to or from the Website does not mean that we endorse and / or have any responsibility for the site in question or anything which appears on it.
You are responsible for all use of the Website on your account whether by you or a third party. Newvista is not liable for any content other than that on the Website, nor are we liable for any data usage / data use charges associated with access to the Website, survey or other research activity on any device; this includes mobile.
We will not be liable to you or any third party for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business, howsoever caused (whether arising out of any negligence or breach of this Agreement or otherwise). We will also not be liable for any failure to perform its obligations under this Agreement caused by matters beyond its reasonable control.
Neither party to this Agreement may, without the written consent of the other, assign, subcontract or otherwise dispose of this Agreement.
This Agreement contains the whole of the Agreement between us and you and they replace all (if any) earlier agreements and/or understandings with you. A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of this Agreement.
We reserve the right to change this Agreement at any time. If we do so, we will include a notice at
and you should then check the changes. You accept that you will have no claim for breach of contract or otherwise in respect of any such alteration. These Terms were last updated on 24th April 2015.
In the event that any term of this Agreement is held to be invalid or unenforceable for any reason, the remainder of this Agreement shall remain valid and enforceable.
For the avoidance of doubt, nothing in this Agreement shall affect your statutory rights.
This Agreement shall be governed by and construed in accordance with the laws of England and Wales.
